KiwiShells Hosting Network - AUP (Acceptable Use Policy)

KiwiShells Hosting Network, referred to henceforth as
"KiwiShells" provides a variety of internet services
including but not limited to World Wide Web page hosting,
Shell accounts, Shoutcast servers, BNC's and IRCd's ;

Hence KiwiShells has certain legal and ethical obligations
regarding the use of its computer network and equipment
involved in the services we provide to you, the client.

1.:Payment & Billing
-All accounts are PrePaid on a month to month basis, payable
on the anniversary date on which you first ordered your account.
(same principal applys with 6monthly and yearly payments)
-All new accounts include free setup; allthough any major
account type change may incur a setup fee.
-Setup fees may differ in price depending on account type, and
your pay period.
-All setup fee's are non-refundable.
-Prices are only guarenteed for the period of pre-payment,
(this applys not only to monthly prepayments,
but 6monthly and yearly also).
-KiwiShells reserve the right to change pricing and plans at
any time without notice.
-Once a client has initiated a subscription, it is their
responsibility to ensure that their bill is payed within
7days of the anniversary date for their account each month.
-When payment for an account has not been received within 7days
of the anniversary date of their account, the account will be
suspended until payment has been receieved in full, and any
descrepancies have been cleared up by direct communication with
the client, and kiwishells administration.
-
2.:Account use and access
-Accounts are for use by the owner ^aka^ the paying client only.
Clients of KiwiShells are not permitted to *give out* their password
as it only creates problems when given to the wrong people.
-- Instant & Permanent termination may follow.
-Clients of KiwiShells are not permitted to resell, share, store,
or give away web hosting services off of their website to other
parties.
This is defined as Allowing a third party to host content on your
account.
-Exceptions to this, include but are not limited to Banners,
images and personal ad's.
-
3.:Account misconduct
-IRCd daemons may only be run on an IRCd account.
Anyone caught running an IRCd daemon on anything other than an
IRCd account will have the process killed once and a warning
email sent.
Repeate offenses will result in account termination without any refund.
-Account misuse includes but it is not limited to DDoSing, hacking,
cracking, xdcc bots/drones, and any illegal activities.
-Child pornography: should child pornography be found in a clients
account the appropriate authoritys will be contacted and the evidence
forwarded onto them along with your details. the account would then
be terminated without refund.
-Kiwishells will take no responsibility for any illegal acts committed
by any of its clients, nor by anyone who has compromised our system.
-Should the need arise at any time, all logs and information, including
all the data & files would be handed over to the authoritys.
-No b/g's on Webhosting Accounts, period.
-
We believe our policys here are strict but fair. if you feel that our
policys would be too hard for you to stick to then perhaps your looking
at the wrong company.

KiwiShells has a 'fair use' policy. If you want to waste resources for
everyone by loading drones on the system, and it's found that you are
responsible for abnormal amounts of lag, you're not being fair to the
other customers. We won't tollerate our system being used to house bots
etc of any kind, and accounts can and will be terminated if found.
